Program Name

South County Microspa SMS Alerts

Program Description

South County Microspa operates an SMS messaging program to send the following types of messages to clients who have opted in:

• Appointment reminders — confirmations and reminders for upcoming scheduled visits
• Event reminders — notifications about upcoming in-spa events, classes, or special programming

This program does not send promotional or marketing messages.

How to Opt In

You opt in to the South County Microspa SMS Alerts program by providing your mobile phone number and expressly consenting to receive SMS messages at the time of booking or account creation. Consent is not a condition of receiving any product or service from South County Microspa.

Message Frequency

Message frequency varies based on your appointment schedule and event registrations. You will typically receive one message per scheduled appointment and one message per registered event. Frequency may increase during periods of high appointment volume.

Message & Data Rates

Message and data rates may apply. Charges are billed by and payable to your mobile carrier. South County Microspa does not charge any fee for SMS messages. Contact your mobile carrier for details about your plan's messaging rates.

How to Opt Out

You may opt out of the SMS Alerts program at any time by replying STOP to any message you receive from us. After opting out, you will receive a single confirmation message and no further SMS messages will be sent to your number.

To opt back in after opting out, reply START or contact us directly at 949-226-9995 or by text at 949-226-9995.

Participating Carriers

Supported carriers include, but are not limited to: AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, Cricket, MetroPCS, U.S. Cellular, Virgin Mobile, and other major U.S. carriers. Carrier support may vary. South County Microspa is not responsible for delays or failures in delivery caused by your carrier.

Prohibited Use

You agree not to use the South County Microspa SMS Alerts program for any unlawful, unauthorized, or prohibited purpose. You may not attempt to access, alter, or interfere with our messaging systems. Any attempt to misuse this program may result in immediate termination of your enrollment.

Limitation of Liability

South County Microspa's SMS messaging program is provided "as is." To the maximum extent permitted by applicable law, South County Microspa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the SMS program, including but not limited to delayed or undelivered messages, carrier failures, or technical interruptions.

South County Microspa's total liability arising out of or related to these terms shall not exceed the amount you paid to South County Microspa in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless South County Microspa and its owners, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of your violation of these terms or your misuse of the SMS program.

Governing Law

These terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, California.

Changes to These Terms

South County Microspa reserves the right to modify these terms at any time. Changes will be posted on this page with an updated effective date. Continued participation in the SMS program after any change constitutes your acceptance of the updated terms.

Your use of the SMS Alerts program is also governed by our SMS Privacy Policy, which is incorporated into these terms by reference.
